Terms of Service
These Terms of Service govern access to and use of the Kudozio platform. By using our services, you accept these terms in their entirety.
1. Acceptance of Terms
By creating an account or using the Kudozio platform, you acknowledge that you have read, understood, and accepted these Terms of Service. If you do not accept these terms, you must not use our services.
2. Service Description
Kudozio is an online review management platform that enables professionals to: - Centralize reviews from various platforms (Google, Facebook, etc.) - Analyze their online reputation through analytical tools - Respond to reviews from a unified interface - Track customer satisfaction trends The service relies in part on integrations with third-party platforms (Google, Facebook, etc.). The availability of these features depends on the proper functioning of these platforms' APIs, over which Kudozio has no control.
3. Pricing and Subscriptions
Kudozio offers three plans: - **Basic**: free, no commitment, allowing you to discover the platform with limited features (2 sources, 1 establishment) - **Plus**: €19/month (or €15/month billed annually) - **Elite**: €59/month (or €47/month billed annually) Prices are listed in euros. VAT is not applicable (article 293 B of the French General Tax Code). Payment is made by credit card through our secure payment provider Stripe. Paid subscriptions are automatically renewed at each billing cycle (monthly or annually). You can manage your subscription and payment methods from your billing portal. Kudozio reserves the right to modify its pricing. Any change will be notified by email at least 30 days before it takes effect. If you disagree, you may cancel your subscription before the new pricing applies. No refunds will be granted for subscription periods already started, including in the event of early cancellation.
4. User Account
To use Kudozio, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. You agree to provide accurate and up-to-date information when registering.
5. Acceptable Use
You agree to use Kudozio in compliance with applicable laws and these Terms of Service. The following is prohibited: - Using the service for fraudulent or illegal purposes - Attempting to access other users' data - Publishing fake reviews or defamatory responses - Disrupting the operation of the platform - Reselling or redistributing access to the service
6. Intellectual Property
The Kudozio platform, its design, source code, and content are protected by intellectual property law. You are granted a personal, non-exclusive right to use the service as part of your subscription. Imported reviews remain the property of their respective authors and original platforms.
7. Limitation of Liability
Kudozio strives to ensure the availability and reliability of its services. However, we do not guarantee uninterrupted operation. Kudozio shall not be held liable for: - Temporary service interruptions for maintenance or updates - Data loss due to force majeure - Content of reviews imported from third-party platforms - Decisions made based on the analytics provided - Unavailability of third-party APIs (Google, Facebook, etc.) In any event, Kudozio's liability under these Terms of Service is limited to the total amount paid by the user during the 12 months preceding the event giving rise to the claim.
8. Termination
You may cancel your subscription at any time from your billing portal. Cancellation takes effect at the end of the current billing period. No pro-rata refunds will be issued. You may also delete your account from your account settings. Upon deletion, your personal data will be removed within 30 days, in accordance with our Privacy Policy. In the event of a breach of these Terms of Service, Kudozio reserves the right to suspend or delete your account without notice.
9. Personal Data Protection
Kudozio collects and processes personal data in order to provide its services. Full details of the processing activities, their purposes, and your rights are described in our Privacy Policy, available at https://kudozio.com/en/privacy. In accordance with the GDPR and the French Data Protection Act, you have the right to access, rectify, delete, and port your data. To exercise these rights, contact us at contact@kudozio.com.
10. Changes to Terms
Kudozio reserves the right to modify these Terms of Service. In the event of a substantial change, you will be notified by email or through a notification on the platform. Continued use of the service after notification constitutes acceptance of the new terms.
11. Governing Law and Jurisdiction
These Terms of Service are governed by French law. In the event of a dispute, and after an attempt at amicable resolution, the competent courts shall be those of the jurisdiction of Kudozio's registered office.
